Terms of Service

These Terms of Service ("Terms") govern your use of Diagix AI (the "app"), a mobile application operated by Diagix AI ("we", "us"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

1. The Service

Diagix AI is a consumer-grade reference tool that provides information about vehicle warning lights, diagnostic trouble codes (DTCs), common symptoms, and general automotive guidance. It uses a combination of curated reference data and an on-device artificial-intelligence model.

2. Not Professional Advice

Important: Diagix AI is for informational purposes only. It is not a substitute for inspection, diagnosis, or repair by a qualified automotive technician. We do not warrant the accuracy, completeness, or timeliness of any diagnosis, suggestion, or cost estimate provided by the app.

Vehicle problems can be dangerous. If a warning light indicates a serious condition, your vehicle behaves abnormally, or you are uncertain whether it is safe to drive, stop immediately and consult a licensed mechanic. You are solely responsible for decisions made using the app.

3. AI Output Disclaimer

The AI assistant may produce inaccurate, incomplete, or misleading information. AI output is generated automatically and is not reviewed by a human before being shown to you. Do not rely on AI output for safety-critical decisions. Always verify important information with a qualified professional.

4. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, subject to these Terms and the store terms of Apple or Google. You may not copy, modify, reverse-engineer, redistribute, or commercially exploit the app.

5. Purchases and Refunds

Diagix AI Pro is a one-time purchase that unlocks additional features (unlimited AI chat, voice input, no ads). Purchases are processed by Apple App Store or Google Play. Refund requests must be made to the respective store, according to their policies; we cannot issue refunds directly.

6. Acceptable Use

You agree not to:

Use the app for any unlawful purpose
Attempt to bypass the paywall, ad system, or license restrictions
Extract or redistribute the on-device AI model or reference data
Use the app to build a competing product
Interfere with the app's security or integrity

7. Intellectual Property

All content in the app — including the interface, reference data, trademarks, and the compiled model — is owned by Diagix AI or its licensors and protected by applicable intellectual-property laws.

8. Third-Party Services

The app uses third-party services including RevenueCat (subscription management) and Google AdMob (advertising, free tier only). Your use of these services is also subject to their terms and privacy policies.

9. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIAGIX AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, VEHICLES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Diagix AI from any claim, liability, or expense arising from your use of the app, violation of these Terms, or violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the app at any time if you violate these Terms. You may stop using the app at any time by uninstalling it.

13. Changes

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the app after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Diagix AI is established, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
